Dear Conwy County Borough Council,

Freedom of Information Act 2000

I request the following information and specific documentation
relating to Llandrillo yn Rhos Primary School, Rhos on Sea;

1.Accounts for recent Audit carried out during October, 2013 at
Rhos on Sea Primary School.

2.The number of;

i) Teaching Assistants related in any way to the [position
removed], [name removed] [name removed] at Llandrillo yn Rhos
Primary School
(Quantity will suffice/no names)

ii) The number of support staff (such as 1:1 support) related
in any way to the [position removed], [name removed] [name removed]
at Llandrillo yn Rhos Primary School
(Quantity will suffice/no names)

3. Details of family relations of the [position removed], [name
removed] [name removed] that have been employed as contractors (in
any capacity) during her employment at Rhos on Sea Primary School
and the financial sums awarded to these contractors.
(In order to avoid breech of data protection, company names can be
used or e.g.; x2 relation for xyz work)

4. The same information as 3 above but for [name removed] [name
removed]' period as [position removed] at Ysgol Llandulas, Minfordd
Road, Llanddulas.

5. For all contracted works tendered from September, 2012 to the
present day,
i) detail the amount tendered by individual companies including the
winning tender/contractor

ii) the actual amount paid to the winning tender at completion of
contract.

6. Confirmation by CCBC that all contractors used are CCBC
Registered contractors with appropriate insurances held on file.

This information is not available from Education Service.

There have been building related works at Llandrillo yn Rhos in 2012-13 &
2013-14 but the County Borough Council has not been involved in any
tendering process. There is provision in the ‘Contract Standing Orders for
Schools Maintained by the Council’ for the tendering and issuing of
contracts to be dealt with entirely by the School.  The LA does not hold
this information.

6. Confirmation by CCBC that all contractors used are CCBC Registered
contractors with appropriate insurances held on file.

* If contractors are engaged by CCBC -  I can confirm that all
insurances are checked and a copies retained by the Authorities
Technical Department (ERF)
* If contractors are engaged by directly by School - (which they have
the freedom to do), it is incumbent on the school to establish whether
the contractor engaged by them is competent to complete the work and
has appropriate insurance and completes the necessary Control of
contractors paperwork. The LA does not hold this information.


Question’s 1, 3 and 4 are covered in the audit investigation. Internal
audit reports/investigations are about evaluation and improvement in
efficiency and effectiveness of the service/organisation. Reports for
example detailing investigations of internal fraud, corruption and/or
theft will contain amongst others things, personal and sensitive
information. Reports are very likely to identify some shortcomings or
areas for improvement which could be exploited if widely known. To that
extent such reports are likely to be regarded as exempt under S36 of the
Freedom of Information Act as any disclosure would be deemed prejudicial
to the conduct of public affairs, i.e. the affairs of the school and/or
Conwy CBC.

S36 is a ‘qualified exemption’ which means that any decision to withhold
the information is also subject to the public interest test. In such a
case, if it is deemed to be more in the public interest to disclose the
information, it should not be withheld.

In accordance with Council procedures in cases where S36 and the public
interest are to be considered, the issue must be put before the Qualified
Persons Group who will make a recommendation to the Council’s Monitoring
Officer who would ultimately make the decision.

Please advise if you would wish your request to be considered further as
per the above.

If for whatever reason you are unhappy with the response please do not

clarity the public interest test is not concerned with what the public are
‘interested in’ per se, but more about what is ‘in the public interest’.
The two are very different.

Something “in the public interest” is simply something which serves the
interests of the public. When applying the test, the public authority is
deciding whether it serves the interests of the public better to withhold
or to disclose information.

Further to my email below earlier today I should emphasis that the
Qualified Persons Group will only be considering questions 1, 3 & 4 of
your request.

Questions 2 , 5 and 6 are not for the LEA to consider any further as the
information is not held. It is not for the LEA to create and/or
request/acquire information from another body if the information is not
held.

You should submit those questions in writing (either by letter or email)
directly to the school who under FOI are obliged to consider if any
information is held by them, and if that is the case consider that

Can I request an update on this request and the meeting convened
13/1/14 please.

For followers of this request, and as recommended by Mr O'Connor, I
have also requested by email of Llandrillo School answers to
questions 2,5 and 6. So far, I have received a reply requesting to
meet with myself. I have declined this invitation as the purpose of
this and all FOI requests is to get information into the public
domain.

Thank you for your email below. I can advise that the Qualified Persons
Group has considered your request on the 13/1/2014 and the outcome of the
meeting is that the requested audit report shall be disclosed to you
subject to the redaction of any personal identifiable information.
Personal identifiable information is subject to the provisions of the Data
Protection Act 1998 and is therefore exempt from the Freedom of
Information Act 2000 by virtue of S40 of that Act.



The necessary redactions are in progress and it is anticipated the audit
report will be ready to send to you within the next few days.



I am unable to comment on any progress with regards to your request made
directly to the school.



I would advise that on occasion I have met with the author of FOI requests
made to CCBC for any number of reasons such as for example, to clarify the
request further, gain a better understanding of what the issues are in the
mind of the requester or even to provide/gain some information and
clarification on the topic of their request before progressing it further.
None of these meetings negate any responsibility for the CCBC (or any
public body) to issue an official and formal response to the request via
whatever chosen media of the requester. With that in mind I would strongly
advise all not to decline such an invitation for the purpose/reason you
state.



I will be in touch again shortly with the redacted audit report.

Dear Derek O'Connor,

Thank you Mr O'Connor.
I note your comments however, the purpose of this request is to
make public the information I have requested. It is possible that I
may/may not already know the answers to my questions and the sole
per pose of this request is to make public my concerns.

Some situations may dictate that by undertaking a meeting a
satisfactory conclusion can be achieved however, not this one.

The delays and difficulty in obtaining this information from both
Council and School would appear to add substance to my concerns.
'Transparency' and 'integrity' . Lets wait and see.

Thank you for your efforts so far, perhaps soon I might receive
some answers!?
